The recent release of ChatGPT and the craze surrounding it has let us know how quickly AI development is taking place.
Generative AI is now coming up with not just text, but images, and music by training enormous amounts of data.
Here comes the issue though as the data is used without restriction, and without consent from intellectual property rights holders.
What IP rights issues are currently being discussed?
What kind of guidelines do we need to protect them?
For an in-depth analysis of this, we welcome into the studio Professor An Junseong at Yonsei University Graduate School of international studies.

Q1. Generative AI is quickly expanding its boundaries with AI art or image generators using text prompts to produce images within seconds. What are the most-used AI art or image generating services? I’ve also heard that tech giants like Microsoft and Adobe are rolling out generative image creation features as well. Could you give us some details?

Q2. These kinds of generative AI services are leading to controversy over what extent copyright should be protected. Getty Images filed a lawsuit against Stability AI –creators of open-source AI art generator Stable Diffusion. What was this about and what are the implications of this lawsuit?

Q3. Such legal struggles are not just limited to those between AI art generators and rights-holders. Around 20 news media outlets criticized OpenAI and its ChatGPT software saying it is using their articles to train its AI tool without paying them. What is this about?

Q4. South Korea’s biggest portal engine, Naver also recently notified media outlets that it will use news content without obtaining prior consent for research and development purposes. Given that Naver is also planning to enhance its ‘Search GPT’, the industry is worried about copyright infringement. How valid are these concerns and how is the issue expected to develop?

Q5. The world’s largest music company, Universal Music Group asked major streaming services like Spotify and Apple Music to block AI companies from using its music to “train” their technology as well. What is this about and how is the music industry being affected by AI programs?

Q6. Another question is how IP rights for productions made by using AI programs should be considered. In February, the U.S. Copyright office reportedly supported copyright registration for a comic book titled “Zarya of the Dawn” whose author used AI software Midjourney to create images for the book. Could you give us details on this and what implications the ruling has?

Q7. The European parliament is reportedly preparing tough new measures for the use of artificial intelligence, including forcing chatbot makers to reveal if they use copyrighted material. Can you tell us more about these measures?

Q8. If content creators are allowed to demand payment for the use of copyrighted materials by AI generators, there are concerns that AI developers would be frozen out by the high costs, potentially hindering further development in the AI industry. What’s your point of view on this?

Q9. In South Korea, there is no law that addresses intellectual properties issue related to AI. Rather, there is a bill pending in the National Assembly on letting AI reproduce or transmit material without obtaining permission for use when data mining. How should South Korea tackle this IP-related issue?

Q10. How about on the international front? Is coming up with an international legal framework possible, and what should be considered when doing so?
